The Party Wall Award, Translated Into Plain English

It’s a strange bit of naming. Nobody wins a party wall award, and nobody loses one either. It’s simply the document that lets the building work happen while keeping both houses protected.

If you’ve been told a party wall award is being prepared, whether you’re the one building or the one next door, here’s what’s actually in it and what it means for the weeks ahead.


What It Is

When a neighbour dissents to a party wall notice, the Act calls that a “dispute”, and the award is how the dispute is settled. It’s a legally binding document, drawn up by the appointed surveyor or surveyors, that says: this work may go ahead, done this way, with these protections.

“Dispute” doesn’t mean a row

In party wall language, a dispute is just the legal state that arises when consent isn’t given. Plenty of awards are prepared between neighbours who are perfectly friendly and simply want things done properly.

What’s Inside One

Every award looks a little different, but you can expect to find:

  • A description of the notifiable work, usually with the relevant drawings attached
  • How and when the work will be carried out, including permitted working hours
  • Any access arrangements over the neighbour’s land for carrying out the work
  • The schedule of condition recording next door’s property before work starts
  • What happens if damage occurs, and who pays for what, including surveyor fees

Who Writes It

  1. 1An Agreed Surveyor, if both owners choose to share one. Quickest and cheapest, and suitable for most domestic jobs.
  2. 2Two surveyors, one appointed by each owner, who agree the award between them. Slower, dearer, but sometimes the right call.
  3. 3A third surveyor, selected at the outset, who only steps in if the two can’t agree. A tiebreaker most matters never need.

Whoever writes it, the surveyors’ duty is to the Act itself, not to the person paying them. Their job is a fair, workable award, and choosing someone good at that job matters. Our guide to choosing a party wall surveyor explains what to look for.

Is It Really Binding?

Yes. Once served, an award is final unless either owner appeals to the county court within 14 days, which is rare and only sensible with strong grounds and legal advice. After that window closes, both sides can rely on it completely: the builder knows what’s permitted, and the neighbour knows what’s protected.

Think of the award as the rules of the road for your building work. Nobody reads the Highway Code for fun, but everyone’s glad it exists at a busy junction.

One Last Thing: Keep It

File the award with your property documents and never throw it away. When you sell, your buyer’s solicitor will want to see it, and a tidy paper trail makes that conversation thirty seconds long instead of three weeks.

An award isn’t red tape. It’s certainty, in writing, for both sides of the wall.
